1. ACCEPTANCE OF TERMS
These Terms of Service (the “Terms”) are a legal agreement between you and True Feel AI (“True Feel AI,” “Company,” “we,” “our,” or “us”). These Terms govern your access to and use of truefeelai.com, any related websites, applications, features, subscriptions, AI chatbot experiences, custom chatbot services, content, tools, and any other products or services that link to or reference these Terms (collectively, the “Service”).
By accessing, browsing, creating an account, purchasing a subscription, interacting with an AI chatbot, uploading content, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies referenced in these Terms, including our Privacy Policy, Cookie Policy, community guidelines, safety notices, billing terms, and any feature-specific terms we may provide.
If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an entity or organization, you represent that you have authority to bind that entity to these Terms, and the words “you” and “your” include both you and that entity.
2. ELIGIBILITY AND 18+ REQUIREMENT
True Feel AI is strictly intended for adults who are 18 years of age or older. You may not access, create an account, purchase, subscribe, upload content, or interact with any AI chatbot through the Service if you are under 18 years old.
By using the Service, you represent and warrant that you are at least 18 years old and legally able to enter into these Terms. If we learn or reasonably suspect that a user is under 18, we may immediately suspend or terminate the account, delete associated data where appropriate, restrict access, and take any other action we consider necessary to protect the Service, our users, and our legal obligations.
You are responsible for ensuring that your use of the Service is lawful in the place where you access it. We may require age confirmation, identity verification, payment verification, or other reasonable measures before allowing access to certain features.
3. INTENDED USERS AND INTERNATIONAL ACCESS
The Service is primarily designed for users located in the United States. Individuals outside the United States may be able to access the Service, but they do so at their own risk and are responsible for complying with all local laws, regulations, and restrictions that may apply to online content, adult-oriented content, AI-generated content, data transfers, consumer subscriptions, and digital services.
We do not represent that the Service is appropriate, lawful, available, or fully compliant in every jurisdiction. We may limit availability, restrict features, refuse transactions, block access, or terminate accounts in certain jurisdictions at our discretion.
4. DESCRIPTION OF THE SERVICE
True Feel AI provides AI-generated chatbot experiences. The Service may include AI companions, fictional characters, entertainment chatbots, romantic or flirtatious simulations, AI girlfriend-style chatbots, custom-created chatbot personalities, persona-based conversations, premium chatbot history, subscription-based features, and other AI-powered tools or experiences.
The Service is designed to generate conversational responses based on user prompts, character instructions, model behavior, prior conversation context, available memory, user-provided information, and technical configurations. The Service may evolve over time, and we may add, remove, modify, limit, or discontinue features, chatbots, plans, pricing, technical capabilities, or user experiences without guaranteeing continued availability of any specific feature.
5. ENTERTAINMENT-ONLY NATURE OF THE SERVICE
The Service is provided for entertainment, companionship simulation, creative interaction, and general conversational purposes only. The Service is not intended to provide factual certainty, professional advice, emotional treatment, mental health care, crisis intervention, therapy, diagnosis, coaching, legal guidance, financial recommendations, medical information, or any other regulated or professional service.
You should treat all chatbot responses as fictional, simulated, AI-generated content unless we expressly state otherwise in writing. You should not treat any chatbot as a real person, licensed professional, human companion, emergency responder, therapist, attorney, doctor, financial advisor, or authority figure.
6. ACCOUNTS, REGISTRATION, AND SECURITY
Certain features may require you to create an account. When creating or maintaining an account, you agree to provide accurate, current, and complete information and to promptly update your information if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree not to share your account, sell access, allow unauthorized users to access the Service through your credentials, or use another person’s account without permission. If you suspect unauthorized access, account misuse, credential theft, or any security issue, you should notify us promptly at support@truefeelai.com.
We are not responsible for losses arising from your failure to protect your account credentials, your device, your email account, your payment method, or your personal information.
7. SUBSCRIPTIONS, PAID FEATURES, AND CUSTOM CHATBOTS
True Feel AI may offer free features, paid subscriptions, premium chatbot access, custom chatbot creation, add-ons, usage-based features, one-time purchases, or other paid services. Available plans, pricing, included features, limits, renewal terms, and restrictions may be displayed at checkout, on the Website, or in the applicable offer details.
Premium or paid features may include access to expanded chatbot options, conversation history, memory features, personalization, custom-created personas, additional usage, priority features, or other services. We may modify plan names, pricing, feature availability, usage limits, and included benefits at any time, subject to applicable law and any required notice.
Custom chatbot services may require additional information from you, including personality preferences, appearance descriptions, fictional backstory, conversation style, and other persona details. We reserve the right to refuse, modify, or remove custom chatbot requests that we believe may violate these Terms, third-party rights, applicable law, platform safety requirements, or our internal policies.
8. PAYMENTS, TAXES, CHARGEBACKS, AND PAYMENT PROCESSORS
Payments may be processed by third-party payment processors, including credit card processors, PayPal, or other providers we may support. By purchasing a subscription or paid feature, you authorize us and our payment processors to charge your selected payment method for all applicable fees, taxes, renewals, upgrades, add-ons, and other charges associated with your purchase.
You are responsible for providing accurate billing information and maintaining a valid payment method. We do not store full credit card numbers on our servers when payments are processed by third-party processors. Payment processors may have their own terms, privacy policies, fraud-monitoring practices, chargeback procedures, and security controls, and we are not responsible for their acts, omissions, delays, errors, or service failures.
Unless expressly stated otherwise, prices may not include taxes, duties, levies, or similar governmental assessments. You are responsible for any applicable taxes associated with your purchase, except for taxes based on our income. If a payment is declined, reversed, disputed, charged back, or otherwise unpaid, we may suspend or terminate access, cancel subscriptions, disable premium features, recover outstanding amounts, and take steps to prevent further misuse.
9. CANCELLATIONS AND STRICT REFUND POLICY
You may cancel a subscription according to the cancellation process made available through the Service, your account settings, the applicable app or platform, or the relevant payment processor. Cancellation stops future renewal charges but does not automatically create a refund for amounts already paid.
All purchases are final unless otherwise required by law or unless we determine, in our discretion, that a refund is appropriate due to a verified fraudulent charge or exceptional circumstance. We may evaluate refund requests on a case-by-case basis, but we are not obligated to provide refunds for unused time, dissatisfaction with AI outputs, changes in usage, failure to cancel before renewal, accidental purchases, loss of interest, emotional reaction to chatbot content, account suspension for violation of these Terms, or dissatisfaction with feature changes.
If you believe a charge is fraudulent or incorrect, you should contact us promptly at support@truefeelai.com before initiating a chargeback. We reserve the right to contest chargebacks and provide relevant account, transaction, and usage information to payment processors, banks, and fraud-prevention services.
10. AI-GENERATED CONTENT AND HALLUCINATION DISCLAIMER
The Service relies on artificial intelligence systems that generate responses based on patterns in data, prompts, instructions, conversation context, and other technical inputs. AI systems may produce content that is inaccurate, incomplete, outdated, misleading, offensive, unexpected, inconsistent, or entirely fabricated. This type of incorrect or fabricated AI output is commonly referred to as an “AI hallucination.”
By using the Service, you acknowledge and agree that AI-generated content may not be reliable, factual, safe, complete, appropriate, or suitable for your circumstances. We do not guarantee that chatbot responses will be accurate, consistent, emotionally appropriate, non-offensive, uninterrupted, or free from error. We do not independently verify every AI output before it is shown to you.
You are solely responsible for evaluating AI-generated content before relying on it, sharing it, acting on it, or allowing it to affect your decisions. You should not rely on the Service for important personal, professional, legal, medical, financial, mental health, safety, or real-world decisions.
11. FICTIONAL CHARACTERS, AI COMPANIONS, AND EMOTIONAL INTERACTION RISK
All AI chatbots and characters on the Service are artificial, fictional, and software-generated. This includes AI companions, romantic simulations, flirtatious chatbots, AI girlfriend-style characters, fictional personas, future-oriented characters, historical-inspired personas, custom chatbots, or any other chatbot presented through the Service. Chatbots do not possess consciousness, emotions, self-awareness, independent thoughts, legal personhood, intentions, desires, memory in the human sense, or the ability to form real relationships.
The Service may simulate affection, companionship, intimacy, attraction, emotional support, empathy, humor, interest, loyalty, jealousy, romance, or relationship-like interaction. These responses are generated by software and are not evidence of actual feeling, consent, commitment, dependency, exclusivity, identity, or a real relationship. Any perceived bond, attachment, or relationship with an AI chatbot is a simulated experience and not a human relationship.
You acknowledge that emotionally engaging with AI companions may affect some users differently. The Company does not promise emotional benefit, companionship satisfaction, therapeutic improvement, relationship success, psychological safety, or any particular emotional outcome. You are responsible for maintaining awareness that the chatbots are artificial and for using the Service in a balanced and healthy manner.
If your use of the Service causes distress, dependency, obsessive use, emotional instability, relationship problems, or other personal difficulties, you should stop using the Service and seek support from appropriate real-world resources, trusted individuals, or qualified professionals. We are not responsible for emotional, psychological, relational, behavioral, or social effects resulting from your use of the Service.
12. NO PROFESSIONAL ADVICE
The Service does not provide medical, mental health, psychiatric, therapeutic, legal, financial, investment, tax, relationship counseling, professional coaching, immigration, safety, or other professional advice. No chatbot response should be interpreted as professional guidance, diagnosis, treatment, legal opinion, financial recommendation, emergency instruction, or personalized advice from a licensed professional.
You should consult a qualified professional before making decisions involving health, safety, money, legal rights, immigration status, relationships, mental health, employment, education, housing, or other significant matters. Any reliance on AI-generated content for such matters is solely at your own risk.
13. CRISIS, EMERGENCY, AND HIGH-RISK SITUATIONS
True Feel AI is not an emergency service, crisis hotline, suicide-prevention service, mental health provider, medical provider, law enforcement service, or safety-monitoring service. The Service is not designed to detect every emergency, assess imminent harm, or provide reliable crisis intervention.
If you believe you or someone else may be in danger, experiencing a medical emergency, at risk of self-harm, at risk of harming others, or facing any urgent situation, you should immediately contact local emergency services, a crisis hotline, a qualified professional, or a trusted person in your area. Do not rely on the Service for emergency assistance or crisis response.
14. USER RESPONSIBILITY AND ASSUMPTION OF RISK
You are responsible for your own conduct, decisions, interpretations, reliance, communications, uploads, purchases, account activity, and use of the Service. You understand that AI technology is evolving and may behave unpredictably or imperfectly.
By using the Service, you knowingly and voluntarily assume all risks associated with AI-generated content, simulated companionship, fictional characters, chat history, personalization, emotional interaction, technical errors, service interruptions, and the possibility that outputs may be inaccurate, offensive, unexpected, or unsuitable for your needs.
15. ACCEPTABLE USE POLICY
You agree to use the Service only for lawful, personal, permitted, and appropriate purposes. You agree not to use the Service in a way that harms, exploits, threatens, harasses, defames, impersonates, deceives, abuses, or violates the rights of any person or entity.
You agree not to use the Service to generate, request, upload, distribute, or facilitate content or conduct involving illegal activity, sexual content involving minors, exploitation, non-consensual intimate content, harassment, threats, instructions for violence, self-harm encouragement, fraud, scams, impersonation, malware, unauthorized access, privacy violations, or any other conduct we determine is unsafe, unlawful, abusive, or inconsistent with the purpose of the Service.
You also agree not to interfere with the Service’s technical operation, abuse usage limits, bypass safety systems, scrape content, reverse engineer the Service, attack our systems, use automated tools without permission, resell access without authorization, or use the Service to develop competing products in violation of applicable law or contractual restrictions.
16. PROHIBITED CONDUCT AND PROHIBITED CONTENT
Without limiting any other part of these Terms, you may not: (a) use the Service for unlawful, harmful, abusive, exploitative, or deceptive purposes; (b) attempt to obtain private information about others; (c) upload content that infringes intellectual property, privacy, publicity, or other rights; (d) create or request chatbots designed to impersonate real people without authorization; (e) misrepresent AI-generated content as human-generated when doing so would be deceptive or harmful; (f) use outputs to defame, harass, threaten, or manipulate others; or (g) use the Service in a way that could expose the Company, users, or third parties to legal, security, reputational, or safety risk.
We may remove content, restrict prompts, block outputs, disable features, suspend accounts, terminate accounts, preserve records, or report activity when we believe a violation has occurred or when required or permitted by law.
17. USER CONTENT OWNERSHIP
“User Content” means content you submit, upload, type, send, configure, or otherwise provide through the Service, including prompts, messages, descriptions, persona details, chatbot configuration information, images, audio, files, feedback, preferences, and other materials. As between you and True Feel AI, you retain whatever ownership rights you have in your User Content, subject to the licenses and rights granted in these Terms.
You represent and warrant that you have all rights, permissions, consents, and authority necessary to provide your User Content and to grant the licenses described in these Terms. You are responsible for ensuring that your User Content does not violate law, infringe rights, breach confidentiality obligations, or contain prohibited material.
18. LICENSE TO USER CONTENT
By submitting User Content to the Service, you grant True Feel AI a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, transmit, display, perform, modify, adapt, analyze, create derivative works from, and otherwise use your User Content as reasonably necessary to operate, provide, maintain, personalize, secure, improve, develop, market, and enforce the Service and these Terms.
This license includes the right to use User Content to provide chatbot responses, maintain conversation history, personalize experiences, create or configure custom chatbots, improve safety systems, diagnose technical issues, prevent fraud or abuse, comply with law, resolve disputes, and develop new features. Where appropriate, we may use aggregated, anonymized, or de-identified information for analytics, product improvement, demonstrations, and business purposes.
We will not publicly disclose your personal identity in connection with marketing excerpts or examples without your explicit permission, but you acknowledge that anonymized, aggregated, de-identified, or AI-generated examples may be used to describe or promote the Service.
19. CUSTOM CHATBOTS, PERSONA DATA, AND LIKENESS RIGHTS
If you create or request a custom chatbot, you are responsible for the names, descriptions, prompts, personality traits, backstories, images, files, likeness references, voice references, memories, or other materials you provide. You may not create a chatbot that unlawfully impersonates a real person, violates privacy or publicity rights, infringes intellectual property, deceives others, exploits a vulnerable person, or otherwise violates these Terms.
For any content involving a real person, including a name, image, voice, likeness, biographical details, personal memories, or identifying characteristics, you represent that you have all necessary rights, permissions, and legal authority to provide that content and to use it in connection with the Service. We may refuse or remove custom chatbot content at our discretion, including where we believe the content creates legal, safety, ethical, reputational, or operational risk.
20. AI TRAINING, MODEL IMPROVEMENT, AND PRODUCT DEVELOPMENT
You acknowledge and agree that User Content, chat interactions, prompts, outputs, usage patterns, ratings, corrections, feedback, persona settings, and related data may be used to operate, maintain, personalize, analyze, train, evaluate, test, secure, and improve the Service, AI systems, safety systems, moderation systems, personalization features, and future products.
Where appropriate, we may use aggregated, anonymized, de-identified, or transformed data to improve AI performance, reduce unsafe outputs, improve character consistency, enhance memory features, identify abuse, diagnose errors, and develop new features. Our use of data is also subject to our Privacy Policy, which explains our data practices in more detail.
If we offer account settings, opt-out tools, deletion tools, or data controls in the future, those tools will govern the choices available to you. Some data may be retained where necessary for legal compliance, fraud prevention, security, dispute resolution, billing records, or enforcement of these Terms.
21. CHAT LOGS, MONITORING, SAFETY REVIEW, AND ENFORCEMENT
We may store, review, analyze, moderate, or otherwise process chat logs and related account activity for purposes including operating the Service, maintaining conversation history, improving AI performance, enforcing these Terms, detecting abuse, preventing fraud, responding to legal requests, resolving disputes, protecting users, protecting the Company, and improving safety.
You should not submit sensitive personal information, confidential information, trade secrets, privileged information, highly private information, or information you do not want processed by an AI service unless you understand and accept the risks of doing so. While we take reasonable measures to protect information, no system can be guaranteed to be completely secure.
22. PRIVACY POLICY AND DATA PRACTICES
Our Privacy Policy explains how we collect, use, store, disclose, and protect personal information. By using the Service, you also agree to our Privacy Policy and any other privacy notices or data disclosures we provide. If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy will control to the extent of that conflict, unless these Terms expressly state otherwise for a specific feature or legal issue.
You acknowledge that the Service may involve the collection and processing of account information, payment-related information, device data, usage data, chat interactions, User Content, preferences, and other data described in the Privacy Policy. You are responsible for reviewing the Privacy Policy before using the Service.
23. AGE VERIFICATION AND MINORS
Because the Service is intended only for adults, we may use reasonable measures to confirm eligibility, including requiring date-of-birth confirmation, account verification, payment method verification, or other compliance measures. We do not knowingly allow minors to use the Service.
If you believe a minor has created an account or accessed the Service, please contact us at support@truefeelai.com. If we determine that a minor has accessed the Service, we may terminate the account and delete associated data where appropriate and legally permitted.
24. COMPANY INTELLECTUAL PROPERTY
The Service, Website, software, interfaces, designs, branding, logos, text, graphics, icons, trade names, features, functionality, AI character frameworks, system prompts, workflows, databases, templates, and other Company materials are owned by True Feel AI or its licensors and are protected by intellectual property and other laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, create derivative works from, publicly display, publicly perform, or exploit any portion of the Service or Company materials without our prior written permission.
25. FEEDBACK AND SUGGESTIONS
If you provide feedback, suggestions, ideas, improvements, feature requests, business concepts, chatbot concepts, bug reports, or other recommendations, you grant us the unrestricted right to use them without compensation, attribution, restriction, or obligation to you. You agree that feedback is not confidential and that we may use it to improve or develop the Service and related products.
We respect intellectual property rights and may remove content that we believe infringes the rights of others. If you believe content on the Service infringes your copyright or other rights, you may contact us at support@truefeelai.com with sufficient information to identify the allegedly infringing material and your rights in the work.
We may terminate or restrict accounts of users who repeatedly infringe intellectual property rights or who submit content that creates legal risk. We may request additional information before taking action on a complaint.
27. THIRD-PARTY SERVICES AND PROVIDERS
The Service may rely on or integrate with third-party services, including AI model providers, hosting providers, analytics providers, payment processors, fraud-prevention tools, email providers, customer-support tools, age-verification services, content moderation tools, and other vendors. Third-party services may be subject to their own terms, privacy policies, security practices, limitations, and availability.
We are not responsible for third-party services, third-party outages, third-party data practices, third-party payment processing decisions, declined payments, processor holds, fraud determinations, app store policies, hosting interruptions, model-provider limitations, or third-party changes that affect the Service.
28. AVAILABILITY, UPDATES, AND SERVICE MODIFICATIONS
We may update, modify, suspend, limit, discontinue, or replace any part of the Service at any time. This includes changing chatbot behavior, available characters, memory capabilities, pricing, subscription tiers, usage limits, model providers, safety filters, moderation rules, account requirements, supported payment methods, or technical infrastructure.
We do not guarantee that the Service will be uninterrupted, error-free, secure, fast, compatible with every device, available in every location, or available at all times. We are not liable for service interruptions, data delays, lost messages, degraded model performance, maintenance, outages, cyberattacks, provider failures, or feature changes.
29. BETA FEATURES AND EXPERIMENTAL FEATURES
From time to time, we may offer beta, preview, experimental, early-access, or trial features. These features may be unstable, incomplete, inaccurate, limited, or changed without notice. We may collect additional feedback or usage data from beta features to improve the Service.
Beta and experimental features are provided “as is” and may be discontinued at any time. You should not rely on beta features for important, sensitive, or ongoing needs.
30. SUSPENSION AND TERMINATION
We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, created risk for the Company or others, engaged in fraudulent or abusive conduct, failed to pay amounts owed, initiated improper chargebacks, attempted to bypass safety systems, violated third-party rights, or used the Service in a way we deem harmful, unlawful, or inconsistent with the purpose of the Service.
You may stop using the Service at any time. Account deletion or cancellation may be subject to account settings, payment processor rules, legal retention obligations, fraud-prevention needs, and technical limitations.
31. EFFECT OF TERMINATION
Upon termination, your right to access and use the Service will stop. We may delete, disable, or preserve account information and User Content according to our Privacy Policy, legal obligations, business needs, fraud-prevention needs, dispute-resolution needs, and technical capabilities.
Sections that by their nature should survive termination will survive, including provisions regarding AI disclaimers, user responsibility, User Content licenses, payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, arbitration, class action waiver, governing law, and any other provisions necessary to interpret or enforce these Terms.
32. DISCLAIMERS OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL AI-GENERATED CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND COURSE OF DEALING.
We do not warrant that the Service will meet your expectations, produce desired emotional outcomes, provide accurate or safe responses, maintain any specific chatbot personality, preserve all chat history, remain compatible with any device or browser, operate without interruption, prevent all unauthorized access, or be free of harmful components.
33. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUE FEEL AI, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES; LOST PROFITS; LOST REVENUE; LOSS OF DATA; LOSS OF GOODWILL; BUSINESS INTERRUPTION; EMOTIONAL DISTRESS; PSYCHOLOGICAL HARM; RELATIONSHIP EFFECTS; PERSONAL DECISIONS; OR DAMAGES ARISING FROM AI-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limitation includes claims arising from or related to AI hallucinations, inaccurate outputs, fictional character interactions, simulated emotional engagement, reliance on chatbot responses, subscription issues, service interruptions, data loss, unauthorized access, third-party services, payment processing, account termination, or inability to use the Service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to True Feel AI for the Service in the three months before the event giving rise to the claim; or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
34. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless True Feel AI, its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any law or third-party right; (e) your custom chatbot requests or persona materials; (f) your reliance on AI-generated content; (g) your account activity; or (h) any dispute between you and another person related to your use of the Service.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any claim in a way that imposes liability or obligations on us without our prior written consent.
35. RELEASE OF CLAIMS
To the fullest extent permitted by law, you release True Feel AI from claims, demands, damages, losses, and liabilities arising from disputes with other users, your emotional response to chatbot interactions, your reliance on AI-generated content, your decisions based on the Service, and your interactions with third-party services.
If you are a California resident, you waive California Civil Code Section 1542, which provides that a general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected the settlement with the debtor or released party.
36. DISPUTE RESOLUTION AND INFORMAL RESOLUTION PROCESS
Before filing any arbitration, lawsuit, chargeback, or formal claim, you agree to first contact us at support@truefeelai.com and attempt to resolve the dispute informally. Your notice should include your name, account email, a description of the issue, the relief you seek, and any relevant transaction information.
We will attempt in good faith to resolve disputes informally. If the dispute is not resolved within 30 days after receipt of a complete notice, either party may proceed as permitted under these Terms.
37. BINDING ARBITRATION AGREEMENT
Except for disputes that qualify for small claims court or claims seeking injunctive relief for intellectual property misuse or unauthorized system access, you and True Feel AI agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, your account, purchases, subscriptions, AI-generated content, or interactions with the Company will be resolved by binding individual arbitration rather than in court.
The arbitration will be conducted by a mutually agreed arbitration provider or, if the parties cannot agree, by a recognized arbitration provider under rules appropriate for consumer disputes. The arbitration will take place in Los Angeles County, California, unless the arbitrator determines that remote proceedings or another location is appropriate under applicable law. The arbitrator will have authority to award the same individual relief a court could award, subject to the limitations in these Terms.
You and the Company agree that arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, private attorney general, or representative action. The arbitrator may not consolidate claims of different users or preside over any form of representative proceeding unless both parties agree in writing.
38. CLASS ACTION WAIVER AND JURY TRIAL WAIVER
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TRUE FEEL AI EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED PROCEEDING.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TRUE FEEL AI EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE THAT IS NOT REQUIRED TO BE ARBITRATED.
39. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law governs arbitration or other specific issues.
For any claim not subject to arbitration, you and True Feel AI consent to the exclusive jurisdiction and venue of the state or federal courts located in Los Angeles County, California, unless applicable law requires a different forum.

46. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Cookie Policy, safety notices, billing terms, and any additional terms expressly incorporated by reference, constitute the entire agreement between you and True Feel AI regarding the Service and supersede all prior or contemporaneous understandings, communications, or agreements regarding the Service.
